Teaching the enforcement question
This guide asks students to hold two things most rooms refuse to hold together: documented rule-breaking at named facilities, and an enforcement record that is mixed rather than absent. The temptation on one side is outrage that flattens the record; on the other, a proceduralism that treats nine unpermitted months next to two schools as paperwork.
Why this is hard to teach.
The material is in motion. A federal injunction was pending when the guide was verified, a permit appeal was open, and the counts themselves change between drone flights. Teaching a moving case means teaching provisionality on purpose: the guide badges this question "in litigation," and a student who learns to say "undecided, with a docket number" has learned something most adults cannot do.
The other difficulty is that the wrongdoing arrives pre-narrated. Students will have seen versions of this story with a villain in the headline, and the reflex is to grade the actors rather than the system. The guide's actual object is the sequence — permit, equipment, operation — and what happens to each legal protection when the sequence reverses. Keep the analysis on the sequence and the incentives, and the named companies become instances rather than the subject.
Target misconceptions.
“If it were really illegal, it would have been shut down.”
Discovery lags: Vineland's generators ran nine months before a state inspection found them, and the Southaven counts came from journalists' thermal drones, not an agency. Enforcement then lags discovery. The record shows the machinery moving (stop-work orders, a paused install, a federal suit) and moving slowly, which is different from not existing and different from working.
“The permit is just paperwork. The pollution is the same either way.”
A permit is a pre-operation review: modeling of what emissions will do downwind, limits, monitoring, and a public comment window, all before the source runs. Skip the review and the modeling becomes an autopsy and the comment period arrives after the exposure. The paperwork is the health protection.
“The fines will sort it out.”
Only if the fine outweighs what the violation buys. The interconnection queue runs years; a head start on training runs is worth enormous sums; historical penalties have been small against that. The live federal case is asking for up to $124,426 per day per violation precisely to test whether the arithmetic can be flipped. Undecided, as of the guide's verification.
“The community air data settles what the turbines did.”
Three measurements disagree: a community project found PM2.5 well above the annual standard, the county health department questioned that data's integrity, and a university study found minimal attributable change. The disagreement is the lesson. When no agency was measuring from the start, every later measurement has a method and a position worth interrogating.
Two classroom-ready activities.
Currency check before teaching: this guide moves faster than its quarterly cycle. Before class, spend five minutes confirming the status of the Southaven injunction and the Memphis appeal; if either has resolved, tell the room what changed and when. Teaching a superseded status as current would model the exact failure this series exists to correct.
The Permit Registry Hunt
40 min · public records · computers requiredStudents search your state environmental agency's public permit registry for any large facility: a data center if your state has one, otherwise a power plant or factory the room knows. They answer four questions: does the facility hold an air permit, what does the permit limit, when was the last inspection, and what did the inspection find.
Some students will find nothing. That is the intended outcome for them: a registry where a known facility returns no record is either an exemption, a threshold, or a gap, and figuring out which is the exercise. Pair the empty-handed students with the ones who found records and have each pair explain the difference.
Close with the Vineland question: the state's answer to "is there a permit application on file?" was no, and that answer became a national story. What made a null result newsworthy there?
Registry interfaces are uneven by state. Do the search yourself first so you know what your state's version of "no results" looks like.
The Operator's Spreadsheet
30 min · no techGive students the operator's decision as a cost table: the interconnection queue in years, the revenue value of months of compute, the permit timeline, the historical fine range, and the odds of being caught before an inspection. Ask them to make the decision the operator's board would make, and to say it out loud.
Most rooms conclude that operating unpermitted is the rational move under those numbers, and the discomfort of saying so is the pivot: if the individual decision is rational, the fix has to change the numbers, not the sermon. Then have students redesign one number (penalty size, inspection frequency, a public generator registry, mootness rules) and defend which lever moves the decision most.

Seeing whether it landed.
The sequence test. Students explain what each protection in the permit process (modeling, limits, monitoring, comment) becomes when the equipment runs first. Four inversions, one sentence each. This is the guide's core mechanism, and a student who has it can analyze the next case without the guide.
The records request. Students draft an actual public-records request to your state agency for a named facility's permit status and most recent inspection report. Grade on specificity: the facility identified precisely, the records named correctly, the statute cited if your state requires one. Some students' requests will be worth actually sending.
The status line. Students write the one-paragraph "where this stands" note for a case from the guide, as of today, with dates. The skill being graded is provisionality: an accurate account that neither overstates ("they got away with it") nor understates ("the system worked") a record that is still moving.

Some of what this guide reports is contested, and I'll tell you exactly which parts. The generator and turbine counts come from thermal drone journalism, not agency inventories; that's the best evidence that exists, and it exists because the official version doesn't. The health data around the Memphis facility is disputed three ways, and the guide shows all three positions rather than picking one. And the biggest question — whether penalties can get large enough to flip the build-first arithmetic — is in front of a federal court right now. I'm not going to pretend to know how that comes out. What I can defend is the documented sequence at each named site, with dates, from the filings and the reporting, and every claim traces to a source you can check.
